AGREEMENT TO OUR LEGAL TERMS

From everyone at Roam, thank you for using our app! We build it to help you plan amazing group trips with ease. Because we don't know every one of our users personally, we have to put in place some Terms of Service to help keep the ship afloat.


When we say "Company", "we", "our", or "us" in this document, we are referring to Roam Travel, Inc., a Delaware corporation doing business as "Roam." Our registered agent is located at 251 Little Falls Drive, Wilmington, New Castle County, Delaware 19808.


When we say "Services", we mean our website at www.travelwithroam.com and the Roam mobile application. This includes all features like our AI travel agent, expense tracking, trip inspiration, flight and accommodation booking, transport booking, and group chat functionality, whether delivered within the mobile app, web browser, or any other format.


When we say "You" or "your", we are referring to the people who create accounts and use our Services.

We may update these Terms of Service ("Terms") in the future. Whenever we make a significant change to our policies, we will refresh the date at the top of this page and notify users through the app or via email.


When you use our Services, now or in the future, you are agreeing to the latest Terms. There may be times where we do not exercise or enforce a right or provision of the Terms; however, that does not mean we are waiving that right or provision. These Terms do contain a limitation of our liability.

If you violate any of the Terms, we may terminate your account. That's a broad statement and it means you need to place a lot of trust in us. We do our best to deserve that trust by being open about who we are, how we work, and keeping an open door to your feedback at support@travelwithroam.com.

Account Terms

  1. You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. We use SMS-based login and notifications to help keep your account secure.

  2. You may not use the Services for any illegal purpose or to violate any laws in your jurisdiction (including but not limited to copyright laws, fraud, or harassment).

  3. You are responsible for all content posted to and activity that occurs under your account, including all messages in group chats and any bookings made through the Services.

  4. You must be a human. Accounts registered by "bots" or other automated methods are not permitted.

  5. You must be at least 18 years old to use our Services.

Our Free Service Model

  1. Roam is free for users. We make money through booking commissions when you book travel through our platform and through affiliate partnerships with travel providers.

  2. Because our app is free, there are no subscription fees, no refunds to process, and no billing cycles. You simply download the app and start using it.

  3. We do not sell your personal data to third parties. Our revenue comes from travel bookings and partnerships, not from selling your information.

How We Handle Your Data

  1. When you use our Services, you entrust us with your data. We take that trust seriously. We do not share your personal data with third parties except as necessary to provide our Services to you.

  2. We use third-party services for essential functions including but not limited to:

    1. Email, sms, push, in-app delivery and communication

    2. Digital advertising, attribution, and analytics platforms

    3. Travel booking APIs to provide you with flight, accommodation, and transport options

  3. When you use our Services, you agree that Roam may process your data as described in our Privacy Policy and for no other purpose. We as humans can access your data for the following reasons:

    1. To help you with support requests you make. We'll ask for express consent before accessing your account.

    2. On the rare occasions when an error occurs that stops an automated process. We get automated alerts when such errors occur. When we can fix the issue without looking at personal data, we do. In rare cases, we may need to look at a minimum amount of personal data to fix the issue.

    3. To safeguard Roam and our users. We'll look at logs and metadata as part of our work to ensure the security of your data and the Services. If necessary, we may access accounts as part of an abuse report investigation.

    4. To the extent required by applicable law. As a US company, we only preserve or share customer data if compelled by a government authority with a legally binding order or proper request, or in limited circumstances in the event of an emergency request.

Account Deletion and Data Removal

  1. Since our app is free, there's no subscription to cancel. You can simply delete the app from your device at any time.

  2. If you want your account and data completely removed from our systems, email us at support@travelwithroam.com and we'll delete your account and associated data.

  3. When you request account deletion, we will remove your data from active systems within 30 days and from our backups within 60 days. We cannot recover this information once it has been permanently deleted.

  4. We currently don't offer automated data export, but if you need a copy of your data before deletion, email support@travelwithroam.com and we'll work with you to provide what we can.

  5. We have the right to suspend or terminate your account and refuse any and all current or future use of our Services for violations of these Terms, illegal activity, or abuse of other users. We reserve this right because we want to maintain a safe, positive environment for all users.

  6. Verbal, physical, written or other abuse (including threats of abuse or retribution) of a Company employee, other users, or travel partners will result in immediate account termination.

Bookings and Travel Services

  1. When you book travel through our Services, you are entering into a contract with the travel provider (airline, hotel, etc.), not with Roam. We facilitate these bookings but are not responsible for the travel services themselves.

  2. All bookings are subject to the terms and conditions of the respective travel providers. This includes their cancellation policies, refund terms, and service standards.

  3. We earn commissions on bookings made through our platform. This doesn't affect the price you pay, but it's how we keep the app free for users.

  4. While we work hard to provide accurate pricing and availability information, travel prices and availability change frequently. Final pricing and terms are determined by the travel provider at the time of booking.

  5. We are not responsible for travel disruptions, cancellations, or changes made by travel providers, though we're happy to help you contact them to resolve issues.

AI Travel Agent and Recommendations

  1. Our AI travel agent provides suggestions and recommendations based on your preferences and available data. These are suggestions only, not guarantees.

  2. While we strive to provide helpful and accurate recommendations, you are responsible for making your own travel decisions and verifying important details.

  3. Our AI learns from user interactions to improve recommendations, but we do not share individual user data with third parties as part of this process.

Group Features and Communication

  1. When you create or join a travel group, you can communicate with other group members through our chat features.

  2. You are responsible for your communications within groups. Be respectful and follow applicable laws.

  3. Group creators have additional responsibilities for managing their groups and ensuring group members follow these Terms.

  4. We reserve the right to monitor group communications for abuse, spam, or illegal activity through specific keywords, though we don't routinely monitor group trip chats.

Modifications to the Service

  1. We're constantly working to improve Roam with new features and enhancements. We reserve the right to modify, update, or discontinue features with or without notice.

  2. Since our service is free, we don't provide advance notice of feature changes, though we try to communicate major updates through the app or email when possible.

  3. We make no guarantees that any particular feature will remain available indefinitely.

Uptime and Service Availability

  1. Your use of the Services is at your sole risk. We provide these Services on an "as is" and "as available" basis.

  2. We work hard to keep Roam running smoothly, but like all technology services, we may experience occasional downtime for maintenance, updates, or unexpected issues.

  3. We do not offer service-level agreements, but we do take service reliability seriously and work quickly to resolve any issues.

Copyright and Content Ownership

  1. All content posted in group chats and other areas of the Services must comply with applicable copyright laws.

  2. You give us a limited license to use the content you post (like messages, photos, or trip details) to provide the Services to you and your travel groups, but we claim no ownership rights over your materials. Your content remains yours.

  3. The Company owns all right, title, and interest in and to the Services, including all intellectual property rights. You may not copy, modify, or reverse engineer any portion of our app or services without express written permission.

  4. You may not reproduce, duplicate, copy, sell, resell or exploit any portion of the Services without our express written permission.

Features and Bugs

We design our Services with care, based on our own experience and feedback from users like you. However, there's no such thing as software that pleases everybody or works perfectly all the time. We test features extensively before releasing them, but like all software, Roam will inevitably have some bugs. We track reported bugs and work through priority ones, especially any related to security, privacy, or core functionality. Not all reported bugs will get fixed and we don't guarantee completely error-free Services.

APIs and Connectors

We work with various travel providers and service partners to bring you booking options and features. We are not liable or accountable for the performance, policies, or actions of these third-party services, though we try to work with reputable partners.

Liability

We mention liability throughout these Terms but to put it all in one section:


You expressly understand and agree that the Company shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) any travel bookings, cancellations, or travel disruptions; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to these Terms or the Services, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.


In other words: choosing to use our Services does mean you are making a bet on us. If the bet does not work out, that's on you, not us. We do our best to be as safe a bet as possible through careful management of the business; investments in security, infrastructure, and talent; and in general giving a damn about building something useful for travelers. If you choose to use our Services, thank you for betting on us.
